Standard Terms and Conditions

Our standard charge is £770/day (per consultant) for a 7-hour day, £110/hr for portions of a day, rounded up to the nearest 15 minutes. This includes telephone support.

1. Fixed Price Work

Is only available for projects likely to exceed 6 days.

When an order is placed for software using a fixed price contract, a deposit of 40% is required before programming work will begin. The remainder of the project cost will be billed on completion. Support to fix any bugs is given at no additional charge for bugs reported during the first month after completion. Thereafter support is charged at our standard daily rate.

2. Estimated Work

We will estimate the cost of completing a project. Once agreed with you, we will begin the project and keep timesheets for all the work we do.

We keep on working until the project is complete or you (for ANY reason) decide to discontinue the work.

You can request interim progress reports at any time and you can decide to discontinue the project AT ANY TIME. In the event that you decide to discontinue the work ALL time expended on the project up to that point would immediately become chargeable.

You may vary instructions in any way via email or verbally, although we cannot be held to specification instructions given verbally. This may of course cause the estimate and possibly the delivery date to change.

You will be charged strictly for the hours (plus expenses) that we expend on the project, whether they prove to be less than the original estimate OR MORE. You are at liberty to challenge us if you feel we have been time wasting but this is not in our interest because we want you to trust us and work with us on other projects.

3. Invoicing

Invoices will be forwarded to a person of your choice. All bills are payable within 30 days of the date of the invoice. We reserve the right, in the event of a failure by the purchaser to make any payment when it becomes due, to defer or cancel any further deliveries and to charge interest on any sum outstanding in accordance with "The Late Payment of Commercial Debts (Interest) Act" 1998.

Kutana Ltd reserves the right to bill larger projects in stages; these will be agreed with the client at the beginning of the project. Smaller projects will be billed at the end of the project.

4. Support

Support is charged at our usual daily rate. The following are specific additions to this:

Software Development - free bug fixes if reported within 30 days of installation.
Products - free support for 30 days.

5. The Code

Unless otherwise agreed with the client, all code written will remain the intellectual property of Kutana Ltd.

6. Delivery

Every effort will be made to meet estimated delivery times but Kutana Ltd cannot guarantee this. We shall not be liable for any costs, damage or loss (whether direct, indirect or consequential) howsoever arising, which may be suffered by the purchaser due to delay in delivery.
